She was given a written warning letter which is a very big deal. The school is responsible to some degree as well. Employers would assume that a person graduating from a degreed program is qualified with some level of competence so the responsibility is there for the program as well. If not it could be the employer sueing after some "scandal" and not the student.
Of course, the reason for this thread is the lawsuit. Can they legally prevent her from pursuing her career by reacting to her behavior with a letter, then deciding, heck, let's pretend she had zero participation?

But, the teacher isn't hiring her. I can see the point in a medical school or something, but it seems to me the teachers responsibility is to grade her classwork which would include a participation grade reflecting that she did participate.
The professor represents the school, which is part of the certifying agency. Say the prof agrees to pass her with a B, she gets certified acts a fool out there, folks are going to wonder who certified her and how did nobody pick her up before she got that far? That's what this prof was doing. Quality Control.
We have a diploma factory known as Wilmington University here in DE. They have a 100% acceptance rate of their applicants. They also churn out some of the worst teaching candidates I have ever seen. People go there because of the acceptance rate, the minimal work/qualifications and because they are cheap. But in the field, when folks find out you went there, nobody looks at you the same (either because you defied the odds and are a professional or because it explains why you're such a dumbass). A teacher down the hall from me had a student teacher from there that was either mentally retarded or SEVERELY socially awkward. We were never able to determine which. He never made it past taking attendance, as that was a challenge for him. She reported him, he was reluctantly pulled from the program....only show up the fall, student teaching in another classroom!

And yet, the judge threw her case out last week.

I'd be curious about the legal opinion as it regards her participation grade. This is all it states in the latest article.
Participation in the therapy internship course required students to behave in a professional manner, give and receive feedback with other students and reflect on their own behaviors and perspectives.
Was it thrown out because she couldn't prove damages, because school's can grade any way they want (the prosecutor's position) or because he behavior was so inappropriate it cancelled out any positive contributions for her participation grade?

Apparently, this class was field work, an internship. Obviously, her behavior would count more here, yet the classwork only portion was a zero and she still got a C+. Her discrimination charge seemed laughable, though.
It's interesting. It seems that, legally, grades can be based on anything.
